General Information
The Clerk's Office is located at Eastpointe City Hall at 23200 Gratiot
Avenue, Eastpointe, MI 48021.
Hours of operation are Monday – Friday, 8:30 a.m. to 5:00 p.m. The City
Clerk’s Office is under the direction of the Deputy City Clerk, Linda L.
Weishaupt. Election questions may be directed to Kimmy Rich at
(586) 445-5026 ext. 2200. Licensing questions may be directed to
Heather Ross at (586) 445-5026 ext. 2202. The Clerk's Office
is responsible for a variety of services listed below. For any

BIRTH CERTIFICATE
A birth certificate is filed at Eastpointe City
Hall, City Clerk's Office, ONLY IF THE BIRTH OCCURRED
IN THE CITY OF EASTPOINTE. This normally consists of a birth that
occurred in a home within the city.
Available birth certificate records date back to
the Village of Halfway, January 1925.
A fee of $15.00 is charged for the first certified
copy of a birth certificate. Each additional copy requested is a $3.00
charge.
The Macomb County Clerk's Office, Vital Records
Department located at 40 North Main, 1st Floor, Mount Clemens issues
certified copies of all birth certificates for Macomb County. Macomb

DEATH CERTIFICATE
A death certificate is filed at Eastpointe City
Hall, City Clerk's Office, ONLY IF THE DEATH OCCURRED
IN THE CITY OF EASTPOINTE. This normally consists of a death that
occurred in a home or in an accident within the city.
Available death certificate records date back to
the Village of Halfway, January 1925.
A fee of $15.00 is charged for the first certified
copy of a death certificate. Each additional copy requested is a $3.00
charge.

The “Business License Application”
is the first step in the licensing process. The application must be
filled out in its entirety. The application will not be processed if
incomplete. Important information is requested that the Police and Fire
& Rescue Departments utilize in case of an emergency. Fees are collected
at time of application based on the type of business in accordance with
the “General Licensing Fee Schedule” adopted by City Council. (See
General Licensing Fee Schedule section.)
The application requires several
departmental approvals. The Clerk's Office will notify the Finance
Department to verify that no personal property taxes are due for subject
location. Generally, this is only of concern when a business changes
ownership and the equipment from the prior business owner remains at the
location with the new owner.
The new business applicant's
second step is to immediately contact the Building Department either by
telephone at 445-5010 or by stopping at Eastpointe City Hall TO
MAKE AN APPOINTMENT FOR AN INSPECTION. The Building Department will
collect an inspection fee for the building inspection and will also
collect the Fire Marshall inspection fee. The Building Department must
issue a Certificate of Occupancy before a business license can be
issued.
The business applicant can contact
the Eastpointe Fire Mashal to schedule an inspection. The Fire
Marshal will notify the Clerk's Office of the results of the inspection.
Approval must be granted before a license will be issued.
The Clerk’s Office will inform the
new business applicant of any departmental disapproval’s. NOTE: Do not
open your business until you have received your license.
Machines must also be licensed.

for specific rules and regulations.
DUTIES OF LICENSEE
Every licensee shall post and
maintain the license issued at the location in a place where it may be
seen at all times.
Every licensee shall permit all
reasonable inspections of the business location and, at all times,
comply with the laws and regulations applicable to such business and all
applicable ordinances and regulations of the City.
Every licensee shall properly
display license stickers on all machines at the business location. Refer
to Mechanical Amusement Devices and Coin-Operated Devices Section for
licensing information.
Chapter 802 of the “Codified
Ordinances of the City of Eastpointe” provides all information on
business regulation and taxation code. This ordinance can be reviewed at
the Clerk’s Office at City Hall, or in the Library, or a copy may be
obtained for the cost of current copy fees.

LICENSE RENEWALS
Business Licenses expire on June
30th of each year.
Renewal applications are mailed in
May of each year to all businesses that were licensed the previous year.
All Personal Property Taxes and
any past due amounts (including false alarm bills) owed to the City must be paid before a license is
issued, including false alarm bills. Courtesy letters are sent in April
to any business delinquent reminding them that in order to renew their
business license all personal property taxes must be paid in full at the
Macomb County Treasurer's Office. Past due amounts owed to the City must
be paid in full at the Finance office.
A license that is not renewed by
June 30th is assessed a 50% late fee penalty for each month late in
addition to the regular license fee.
Several reminder letters are sent
to businesses that have allowed their license to lapse before the matter
is turned over to the City Attorney for legal action.

MECHANICAL AMUSEMENT AND
COIN-OPERATED DEVICES
A license is required for each
machine that is considered a mechanical amusement or coin-operated
device. Stickers, furnished by the Clerk's office, shall be displayed
on each licensed device.
Examples of a mechanical
amusement device would be a skill ball, dart board, mechanical grab
machines, television display devices and all games machines operated
by mechanical or electrical means.
Coin-operated device means any
machine or instrument which may be operated or set in motion upon the
insertion of a coin, token, card, etc. and would include vending
machines for pop, foods, candy, cigarettes, gum, juke boxes, pool
tables and similar items. Pay telephones, newspaper vending devices,
ATM, and stamp machines are exempt.

These fees are in addition to
General Business License Fees.
An establishment containing four
or more mechanical amusement devices would be considered an “Arcade”
and subject to additional regulations.
The use of any amusement device
or coin-operated machine for gambling of any kind is strictly
prohibited.
Chapter 848 of the “Codified
Ordinances of the City of Eastpointe” provides specific information on
all rules and regulations. This ordinance can be reviewed at the
Clerk's Office at City Hall, or in the Library, or a copy may be
obtained for the cost of current copy fees.

HOME OCCUPATION LICENSE
In 1996 the City Council
amended the ordinance regarding residential districts to allow
certain occupations to be operated/licensed out of the home. This is
provided the definition of home occupation is met and the owner
complies with listed conditions and ALL general licensing
requirements.
HOME OCCUPATION – means a
gainful occupation or profession customarily conducted entirely
within a dwelling unit and carried on by the inhabitants thereof,
which use is incidental and secondary to the use of the dwelling for
dwelling purposes and does not change the character thereof.
PRINCIPAL USED PERMITTED
 |
They are conducted wholly
and entirely within the dwelling. |
 |
They are located either in
the basement of the principal dwelling, or when they are not
located in the basement, they shall not occupy more than 25% of
the floor area in the principle dwelling, excluding the basement.
|
 |
They are conducted only by
the inhabitants thereof as defined in the Zoning Code, there being
no other employees or assistants employed in connection with a
home occupation. |
 |
No article shall be made or
sold or offered for sale except such as may be produced or
provided by the inhabitants thereof. |
 |
There shall be no equipment
or machinery used in connection with a home occupation which is
industrial in nature, or which will have a negative impact on
adjacent residential property. |
 |
They do not change the
character of the residential appearance, or the orientation of the
dwelling unit as a residential use. |
 |
They will not require
internal or external alterations or construction other than that
which may be required to meet local or State safety or
construction code standards, as authorized by the City.
|
 |
No home occupation shall be
carried on to an extent that will require parking in excess if
that required for a residential building by the Zoning Code.
|
 |
They shall have no signs,
advertising devices or other manifestation located on the exterior
of the dwelling structure or within any yard area which suggests
or implies the existence or a home occupation. |
 |
The home occupations does
not include clinics, hospitals, barber or beauty shops, tea rooms,
tourist homes, kennels, millinery shops or any other use similar
to the above use which does not meet the above requirements.
|
 |
The home occupations
complies with the licensing requirements in Chapter No. 802, as
amended. |
 |
Home occupations shall be
reviewed by the Building Department. The Building Department may
forward the request to the Planning Commission for its review.
When the Building Department or the Planning Commission has
determined that the above conditions are met, the Building
Department shall issue a special occupancy permit with conditions
enumerated thereon. Once established, no home occupation shall
deviate from the above required conditions. No home occupation
shall be continued when the same shall be found by the Building
Department to be a nuisance or to be in violation of the above
conditions due to noise, electrical interference, dust, smoke,
odor, vibration traffic congestion, reduction or parking, or
reduction in the overall living environment of the dwelling or the
surrounding area. |
Note: No Vehicles allowed on
property other than 3/4 ton truck or less.

Occupation License may be made in the Eastpointe Municipal Offices
Clerk’s Office.

The license fee is $15.00 and
expires on June 30th of each year.

DOG LICENSING GENERAL
INFORMATION AND COSTS
Every property owner or occupant
in the City of Eastpointe who possesses, harbors, shelters, keeps, or
has custody of any dog is responsible for obtaining a license within
30 days of moving into the City or acquiring a new dog, for any dog
that is 4 months old or older, for each dog up to two dogs as
permitted by ordinance. Residents are required to apply for a license
on or before March 1 of each year, and must provide proof of
vaccination for rabies (Veterinarian certification) in accordance with
State Law. All dogs shall have and wear at all times a collar with
license tag securely attached.

rabies vaccination signed by a licensed veterinarian.

ONLY dog owners whose rabies vaccination expires in 2012 or

PURPOSE & THE LAW
To protect the health, safety,
and welfare of Eastpointe residents, business owners, and visitors; to
prevent unhealthy and unsafe conditions in neighborhoods, and further,
in order to notify owners of lost or impounded dogs.
The law governing dogs can be
found in Chapter 610 of the “Codified Ordinances of the City of
Eastpointe”. These ordinances can be reviewed at the Clerk's Office at
City Hall, or in the Library, or a copy may be obtained for the cost
of current copy fees.
The City enforces the ordinance
pertaining to dogs through its Police Officers and an Animal Control
Officer, whose duties include investigating and writing tickets to
enforce the laws and ordinances concerning animals. The City also
employs dog canvassers who check door-to-door for dog licenses each
year. The canvassers also issue tickets when dogs are found
unlicensed.

KENNEL PERMIT
Whenever a resident in the City
of Eastpointe desires an exception to the two-dog limit, the following
procedure applies:

The applicant must agree to neuter all dogs in
his/her possession in a manner that prevents reproduction unless the dogs are for show.

The reasons for the
circumstances surrounding the request must outweigh the risk of
disturbing the peace and quiet of the neighborhood, as determined by
the Chief of Police. It also must be shown that the applicant has not
been convicted of violating any provision of Animal Code, Chapter 610.
In addition to these conditions, the applicant must meet all other
licensing requirements.

COMMON DOG COMPLAINTS
Loud, frequent, or constant
barking and howling. The City has and enforces an ordinance for
barking and howling dogs that may cause annoyance to the neighborhood
or the general public.
Dogs running free. The City has
and enforces an ordinance that does not allow animals to run free or
at large.
Failure to remove and dispose of
feces on the owner's property. This condition allows for potential rat
harborage to exist and is enforced under Chapter 1860 of the “Codified
Ordinances of the City of Eastpointe.”

FREQUENLY ASKED QUESTIONS
How soon must I buy a license
when I move into the City?
You must obtain a license within 30 days of moving into the City.
How soon must I buy a license
when I acquire a new dog?
If the dog is older than four months, you have 30 days from the date
you acquired the dog.
How soon must I buy a license
for a new puppy?
You must obtain a license within 30 days after your puppy becomes four
months old and has received its vaccination for rabies. A puppy
license is available at a lower cost. Call the City Clerk's
office at (586) 445-5026 for more information.
What should I bring when I
come to purchase my license?
You will need to provide proof of vaccination for rabies (Veterinarian
certification) and if your dog has been spayed/neutered since the last
license purchased, a copy of the paperwork for verification.
I thought puppies could not
be vaccinated until they were six months old?
The American Veterinarian Medical Association (AVMA) now requires any
dog four months or older to have their rabies vaccination.
What is the licensing date
each year and will I receive a reminder?
The licensing date as of 2000 is March 1st of each year. You will
receive a letter with paperwork for each dog in your home currently
licensed each year. Notices are also advertised in the local paper as
an additional reminder.
Is there a late fee?
Yes, any dog licensed after March 1 (except new pet, within a 30-day
limit) is charged an additional $10.00 late fee.
Why do I have to provide a
daytime phone number or pager number when my home telephone number has
already been listed?
Most often dogs stray while the owner is at work. This number will
assist the Animal Control Officers in contacting you as soon as
possible and possibly preventing an overnight stay for your family
member at the Macomb County Animal Shelter.
What if I have more than two
dogs?
If you have more than two dogs you are required to obtain a
Dog Kennel
Permit.

Why does my dog have to wear
his tag at all times?
We receive many calls from concerned homeowners that have found a dog
with a tag and seek information in order to return him to his owners.
The Animal Control Officer and Police Officers also use this to
quickly contact an owner in order to return a pet that has strayed.
Besides your pet's safety, it assures everyone that your dog has been
properly vaccinated and licensed.
What is considered proof for
a show dog?
The owner of a show dog must provide proof of two shows for the
previous year. Proof is required each year.

MISCELLANEOUS LICENSES
AUCTIONEER LICENSE
GENERAL INFORMATION
The City of Eastpointe requires an auctioneer license be obtained before
the selling of any personal property at public auction. The licensed
auctioneer shall operate a public auction room or sell goods at public
auction from Monday through Saturday of any week between the hours of
8:00 AM and 10:30 PM. No public auction shall be conducted on
Sunday. The auction can not take place in any street, alley
or public place in the City. This license does not apply to the sale of
goods and merchandise under legal process or upon foreclosure.
The City Clerk shall waive the surety bond requirement and deposit
requirement for nonprofit organizations, and said nonprofit
organizations must comply with the requirements of Section 806.01 of the
city code of ordinances. Contact the Clerk's

Chapter 806 of the “Codified Ordinances of the City of Eastpointe”
provides specific details on the sale of jewelry, substitution of
articles, fraud, minors, etc. This ordinance can be reviewed at the
Clerk's Office at City Hall, or in the Library, or a copy may be
obtained for the cost of current copy fees.
APPLICATION AND COST
Application for an auctioneer license may be made in the Eastpointe
Municipal Offices, Clerk's Office, Room 6. The auctioneer's place of
residence and place of business is required in the application process.

$70.00 Fee
$3,000 Surety Bond (conditioned for observance of city ordinances)
Nonresident of the City shall deposit $1,000 with the Finance Director
(this deposit will be held until the payment of all City taxes owing)
POSTING REQUIREMENTS
An identification card will be issued by the Clerk's Office stating the
date and time the auction is to be held. A photocopy of this card shall
be posted in a conspicuous place so that it can be readily seen. Also
posted with the above photocopy, for public inspection, a copy of
Chapter 806, Auctioneers.

BICYCLE LICENSE
GENERAL INFORMATION AND COST
Bicycle licenses are issued in four-year cycles. A license may be
purchased at any time and the cost pro-rated according to the years
remaining in the cycle. The four-year cycle began with the license in
2005 at a cost of $1.00. A license purchased in 2006 will
cost 75 cents, in 2007 will cost 50 cents, and in 2008 will cost 25
cents. All licenses will expire December 31, 2008.

Application for a bicycle license can be made at the Eastpointe
City Hall, Clerk's Office. The following information
will be required:

GOING OUT OF BUSINESS SALE LICENSE
GENERAL INFORMATION
The City of Eastpointe requires a Going Out of Business Sale license. A
“going out of business sale” means any sale described as such or
described as “closing out sale,” “liquidation sale,” “lost our lease
sale” or “forced to vacate sale,” held in such a manner as to indicate
that upon disposal of the goods the business will cease at the location
where the sale is conducted.
Chapter 828 of the “Codified Ordinances of the City of Eastpointe”
provides specific information. This ordinance can be reviewed at the

obtained for the cost of current copy fees.

Application for a Going Out of Business Sale may be made in the

sale. The license applies only to location specified and may not be
transferred or assigned. The license may be renewed not more than twice

meets all provisions required of M.C.L.A. 442.211, Regulation of Certain
Sales.

ICE CREAM VENDOR LICENSE
GENERAL INFORMATION
The City of Eastpointe requires all persons selling ice cream from a
vehicle obtain an ice cream vendor license. Pushcarts and bicycles are
prohibited. Sales are allowed between the hours of 9:00 a.m. to 9:00
p.m. Sales are not allowed on Kelly Road, Gratiot Avenue, Eight Mile
Road, Nine Mile Road or Ten Mile Road. Sales are not allowed within 500
feet of any school entrance between 9:00 a.m. and 5:00 p.m., when school
is in session. Parking on school property or public park property is
allowed where proper permission is granted.
Chapter 836 of the “Codified Ordinances of the City of Eastpointe”
provides specific information on all requirements especially lighting,
required signage, and noise (music/bell). This ordinance can be reviewed
at the Clerk's Office at City Hall, or in the Library, or a copy may be
obtained for the cost of current copy fees.
APPLICATION AND COST
Application for an ice cream vendor license may be made in the
Eastpointe City Hall, Clerk's Office. The following
requirements must be met before a license will be issued:
Each/every operator of any ice cream vending vehicle must be licensed.
Must be at least 18 years of age.
Must submit on Police Department forms certificate of good character
from two reputable residents.
Must submit on Police Department forms statement with various
information including prior convictions.

POSTING REQUIREMENT
Each ice cream vending vehicle will be issued a sticker that must be
placed on the drivers left lower windshield. Each and every operator
must carry their license with photograph issued to them while operating
an ice cream vehicle. The Eastpointe Police Department, for the safety
of our children, will enforce these requirements.

GENERAL INFORMATION
The City of Eastpointe requires any person selling goods or taking
orders for delivery in the future “door to door” be licensed. A food
item would also require a food handler card obtained from the Macomb
County Health Department prior to a license being issued.

SNOW REMOVAL SERVICE PERMIT
GENERAL INFORMATION
The City of Eastpointe requires that any person who for hire operates
any snow removal equipment of a scraper or plow-type operated by a
motor-driven vehicle obtain an annual permit. Snow removal permits
expire on September 30 of each year and are not transferable during the
permit time. Operators of snow removal equipment should not deposit snow
onto any public right of way or allow snow to accumulate in such a
manner as to obstruct the view of drivers or pedestrians. The Department
of Public Works and Service and the Police Department will enforce these
regulations.
Chapter 870 of the “Codified Ordinances of the City of Eastpointe”
provides specific information on snow removal regulations. This

TAXI CAB LICENSE
GENERAL INFORMATION
The City of Eastpointe requires that any person who operates upon the
streets of the City any taxicab for hire obtain a license. The license
cannot be issued until City Council has approved the need for the
service for public convenience and necessity and issued a certificate
certifying such. City Council approves the number, kind, type, equipment
and schedule of rates to be charged. The Clerk's Office then issues and
renews the license each year thereafter.
Chapter 872 of the “Codified Ordinances of the City of Eastpointe”
provides detailed information on the rules and regulations for taxicabs.

ABSENTEE VOTER APPLICATION
You may vote by absentee ballot
if you meet any one of the following provisions:

to obtain an Absentee Ballot for all future elections. This request
will prompt an Application for an Absent Voter's (A.V.) Ballot to be
mailed to you prior to each election. This form must be completed for
each election before the Clerk's Office can process an Absentee
Ballot. The form should include your signature (at the middle and
bottom), current date, and address where your ballot is to be mailed
if other than your registered address. Michigan law requires that A.V.
Ballots be sent to your registered address unless you are
hospitalized, institutionalized, or at an address outside of your
community. Once your application has been received, the ballot will be
mailed to the voter.

The deadline for application is
2:00 p.m. on the Saturday preceding the election. The Clerk's Office
at City Hall is open on this Saturday for election purposes only. If
the deadline has passed and you have found that an A.V. ballot is
required, you may come to the Clerk's Office up to 4:00 p.m. of the
day preceding the election. At this time an application will be
completed and a ballot will be processed immediately. You must vote
the ballot at this time.
Emergency application can be
made up to 4:00 p.m. of Election Day. Reasons are confined to sickness
or physical disability, absent from the community because of sickness
or death in the family. Either of these events must have occurred at a
time that made it impossible to apply by the Saturday 2:00 p.m.
deadline.

ABSENTEE VOTER
BALLOT
Your absent voter ballot will
arrive in the mail with a complete instruction sheet and secrecy sleeve. Please use
a blue or black ink pen to mark the ballot as noted in the
instructions on the ballot.
After voting a ballot, place the
ballot in the secrecy sleeve. Place the secrecy sleeve in the return
envelope and securely seal. Sign and date the return envelope in the
place designated. Your signature must appear on the return envelope or
the ballot will not be counted. If you are disabled or otherwise
unable to mark the ballot and required assistance in voting your
absent voter ballot, have the person who assisted you complete the
section on the return envelope entitled “TO BE COMPLETED ONLY IF VOTER
IS ASSISTED IN VOTING BY ANOTHER PERSON.”
The ballot is ready to be
returned by any of the following methods:

Place the necessary postage
(EXTRA POSTAGE IS REQUIRED AND WILL BE STAMPED AS A REMINDER) on the
return envelope and place in the mail.

Deliver the envelope personally to the Clerk's
Office at City Hall.

ONLY A MEMBER OF THE IMMEDIATE FAMILY of the
voter including a father-in-law, mother-in-law, brother-in-law,
sister-in-law, son-in-law, daughter-in-law, grandparent, or
grandchild, or a person residing in the voter's household may mail
or deliver a ballot to the clerk for the voter. The law does not
allow a neighbor or a friend to deliver your ballot.
Remember the ballot must reach
the Clerk's Office before the close of the polls on election day. An
absent voter ballot received after the close of the polls on election
day will not be counted.
If you make a mistake on your
ballot, please bring the ballot, instructions and envelopes back to
the Clerk’s Office at City Hall. A new ballot will be issued to you
immediately while you wait.

ELECTION INSPECTORS
The City of Eastpointe accepts
applications for election inspectors

Adobe website) year round. Election inspectors
are asked to be at their assigned precincts by 6:30 a.m. Chairpersons
report to City Hall at 6:00 a.m. to pick up their poll book, keys,
etc. Voting precincts open at 7:00 a.m. and remain open until all
voters in line at 8:00 p.m. have voted. The chair and inspectors then
close the polls and prepare their precincts to report totals to City
Hall. The closing and reporting of the precinct varies in time with
some precincts reporting as early as 9:00 p.m. With large elections
such as the Presidential, precincts can report in as late as 1:00 or
2:00 a.m. All inspectors are asked to remain with their precinct until
all closing procedures have been completed and the chairperson leaves
to report to City Hall.
All chairpersons and assistant
chairpersons are asked to attend a training session prior to each
election. At various elections, all inspectors are asked to attend the
training session. Letters are sent out early requesting attendance.
The session is usually held at City Hall from 6:00 p.m. until 7:30 or
8:00 p.m. Inspectors are paid for their attendance.
PA 158 of 1997 allows municipal
officials to appoint 16 or 17 year olds as election inspectors subject
to restrictions. Any student interested in experiencing the election
process as an election inspector should contact the Clerk's Office at
445-5027 ext 2200. The City of Eastpointe will work with the school
district to set up a program whereby students can take advantage of
this opportunity.

Elections for City Offices and East Detroit School
Board Seats are held in odd years.
Effective January 1, 2004, the 38th District
Court shall commence to function. As of that date, the Municipal
Court is abolished. The terms of the incumbent Municipal Judges shall

TEMPORARY POLITICAL SIGNS
Temporary political signs are permitted before an
election, subject to the following conditions:

Size. Such signs in residential districts shall
not exceed six (6) square feet in an area per side; in commercial
and office districts, shall not exceed sixteen (16) square feet in
area per side and in industrial districts shall not thirty-two (32)
square feet in area per side.
-
Erection. Signs can be erected by the land owner
or tenant or with the permission of the land owner or tenant.
-
Location. Signs shall not be located in, project
into or overhang any public property, right of way, sidewalk or
dedicated easement. Signs should not be located in a manner that
interferes with traffic safety and visibility of motorists and
pedestrians.
-
Removal. Signs, sign structures, etc. shall be
dismantled and removed not more than 14 days after the election.
Removal shall be the joint responsibility of the person erecting the
sign, the land owner or tenant of the property where the sign exists
and the candidate or party whose name or identity the sign intends
to promote.

absent voter lists, and previous election voter lists should be made

The staff of the Clerk’s Office wishes to accommodate all candidates
requests for information, however, last minute/late requests hamper
the office in processing and performing all legal requirements that we

ELECTION DAY REMINDERS
All poll workers must be at least 100 feet from any
doorway used by voters to enter the building in which the polling
place is located.
All campaigning via signs, posters, or bumper
stickers placed on cars must also be parked at least 100 feet from the
entrance to the building in which the polling place is located.
Poll workers and supporters that are wearing
campaign buttons or clothing that bears a campaign slogan or
candidates’ name, must remove the button or cover up clothing when
entering the polls to vote.
